Howard Stern, popular talk radio personality and controversial celebrity is on his soap box advising his fans and friends to pay close attention to the up coming trial in Washington D.C. The federal government against John Stagliano.
Stagliano owner of Evil Angel Productions is being charged with shipping two DVD titles to a community that has deemed such material to be obscene and undesirable. Stagliano is also being charged with a third count of obscenity for one of the Evil Angel movie trailers on it's web site.
The Evil Angel web site has all the normal warnings that exclude anyone under the age of 21 from entering, the site clearly states, if you find adult material offensive you should not enter.
Stern, a proponent of the first amendment and freedom of speech pointed out, "John Stagliano and Evil Angel should not be the ones being charged with anything here. The person or persons responsible for ordering these materials should be the ones being charged. They are the ones breaking the laws their community has set up to protect them from themselves".
As members of a community that has put up such restrictions against adult material it seems they would want to prosecute and weed out the bad seeds in their own neighborhood. They ordered the materials, they entered a site that clearly warns internet users of the content of the site. Not only did they do that, but they took the time to select a trailer, push the play button and waited to be offended.
"Many times our laws are ass backwards," Stern went on to say, You don't kill the messenger, you kill the person responsible. In this case the responsible party is the one that ordered the offensive DVD's" into a community that clearly objects to such material".
Many agree this trial has far reaching implications aside from the adult industry including, freedom of speech and laws governing internet commerce.
