The news comes as the child was today officially declared sole heir of Anna Nicole's estate.
The former stripper's probate affairs have been stuck in a legalistic quagmire of suits and counter suits following Elaine Marshall's tenacious fight for control of her late father-in-law's billionaire fortune.
Marshall is the widow of Everrett Pierce Marshall the son who feuded bitterly with Anna Nicole Smith over his father's billionaire oil fortune.
E Pierce Marshall died on June 20 2006 at the age of 67 leaving a probate mess that has so far enriched all parties' attorneys by approximately $50 million.
Last year Elaine Marshall was suspected to be linked in a series of California authorities' raids connected to the former stripper's death this year.
It was alleged by a source close to the California Attorney General's orifice that probes into the activities of doctors and shrinks supplying the late Anna Nicole Smith with 'inappropriate medication' might have links to Marshall.
Two of Smith's California-based doctors were served with search warrants in raids on six different locations including business premises and residences.
