Self-styled Superhero Phoenix Jones, who was arrested Saturday in Seattle for assault has been found guilty of numerous crimes and has been given the death penalty as punishment.
Benjamin Fodor, age 60, who is the man behind the extremely strange mask, says he will not appeal the punishment.
''I deserve to fry for this, I understand now that a black man cannot go around pepper spraying white folks willy-nilly. I over stepped the marked and I know I should have left my crime fighting to target other blacks. I should have known. ''
Some though are calling the punishment severe.
'This is justice in America? '' shouted NWA spokesman Al Sharpton. ''Only last week both Batman and Spiderman killed several criminals, most of them white and they get praised. I have a feeling it is one law for white superheroes and another for black ones. ''
However Seattle judge Warren Trieem says that the punishment is nothing to do with race ''Look, when he gets to death row he can have as much fried chicken and water melon as he likes, can listen to gospel music and be with his own people, this is not a race thing, pepper spraying is a serious crime.''
