PHOENIX, AZ -- Ben and Jerry are being sued over ice cream that was claimed to be too cold. According to the complaint, filed in Maricopa County Court, Emilio Estanza-Gomez was enjoying an ice cream cone while driving his newly purchased automobile.
Mr. Estanza-Gomez claimed the much too cold ice cream gave him such a severe brain freeze headache that it distracted him causing him to go through a stop sign and drive off the road into a ditch.
He states in his complaint that he suffered major injuries to his groin area and is no longer able to enjoy the benefits of his marriage bed or his SUV.
The police report listed the flavor as 'rocky road.'
