Albany NY: Governor Andrew Cuomo called the New York (NY) State Legislature back into a special October 2011 session to deal with the alarming increase in the rate of same sex divorce. In June 2011 during the final hours of the session same sex marriage became legal in NY State, as of July 1, 2011.
Legislators had dealt with the problems of religious organizations not having to perform same sex marriage without being sued for discrimination or civil rights violations. However, same sex divorce was never considered and between July 2011 and the end of September 2011 this problem surfaced.
The NY State Legislature must now deal with the issues of irreconcilable sameness, who gets alimony, child support, child custody and parental visitation rights, divorce courts favoring which mother (father), property distribution (NY is an equitable distribution state when relating to marital property.) and adultery. Adultery is a particularly thorny issue to resolve, as a recently married couple Jane and Margaret split up over an alleged sexual relationship with Fred and Bob or it could have been Fran and Barbara.
Cheap and quick New Jersey (NJ) same sex divorce mills have become prevalent in towns bordering on NY State and elsewhere in NJ. While NJ doesn't recognize same sex marriage, smart divorce lawyers have argued in court there's no prohibition against same sex divorce in NJ. Republican Governor Chris Christie was not pleased when he was told Trenton NJ rivaled Reno NV as the same sex divorce capitol of the USA.
NY State Democratic legislators are calling for tax increases to handle any additional state legal services. However, Democratic Governor Cuomo threatened to veto any new tax and spending programs!
