Fourteen years after it first went before a jury, Summers vs. California --the first case when a Mutant-American was compelled by the Mandatory Mutant Gene Suppression Act of 2039 to accept the so-called "Mutant Cure"-- will heard before the US Supreme Court.

27-year-old mutant Scott Summers has the ability to project from his eyes beams of energy, which are highly-focused electromagnetic radiation in a red wavelength, but do not give off heat and instead deliver concussive force.

The premise is funny...
... but this isn't. Sorry. I'll try harder.

Summers is one of the few mutants who can not control his ability: He can not turn off the beams, and must constantly wear special glasses which block the beams.

In 2040, Summers was Ordered by a California State court to have mutant gene suppression therapy, using the "greater good" language of the Act.

"The atypical manifestations of human physiology which mutants exhibit can be no less a natural occurrence than the ability to use our opposable thumb or conquer bacterial infection via our immune system," said the Court in granting Summers' Writ of Certiorari.

"While these manifestations are the inalienable right of those who possess them, the legislature has an obligation to put into place laws which govern how these manifestations can be wielded, just as they govern how abilities like the use of a pugilist's fists in an altercation.

"Our task, in its simplest form, is to temper the rights of mutants with the responsibility to protect the non-mutant populace."

Oral arguments will begin in October.
