NEW YORK CITY - Attorney's for Madonna have filed a motion in New York City's 13th District Court regarding what they are alleging to be copyright infringement.
The writ which was filed in Judge Payman "Skipper" Alderbeer's court stipulates that the party of the first part (Madonna) is asking that the party of the second part (Lady Gaga) pay her royalties in regard to the first party's hit song "Express Yourself."
The first party alleges that the second party stole parts of the song and used them in the second party's hit song "Born This Way."
The Brooklyn law firm of Fitzowitz, Straydiddle, & Goldenbocker has been hired by Madonna.
Lady Gaga is being defended by California attorney Ginger Allred.
Ms. Allred is contending that the songs are similar in the fact that they both have lyrics and music like 97 percent of all songs have.
She noted that one big major difference is the fact that the song "Express Yourself" is 5 minutes and 2 seconds long, whereas the song "Born This Way" is 5 minutes and 19 seconds long, clearly a difference of 17 seconds.
SIDENOTE. Attorney Allred spoke off-the-record with the iRumors News Agency and stated that what it boils down to is that basically Madonna is jealous as hell of Lady Gaga who is younger, prettier, and cellulite-free.
